Litigation and Investigations Counsel (“Counsel”) will serve on Medtronic’s corporate Litigation and Investigations team and will focus on developing and implementing strategy to drive successful outcomes for the enterprise; managing litigation and investigations to achieve strategic objectives within budget; hiring, supervising and working closely with outside counsel; providing oversight to in-house paralegals; engaging in and driving early evaluation and resolution of claims; and providing legal advice and counsel to business clients on issues related to risk assessment, regulatory compliance and litigation risk avoidance. This position will report to the Vice President, Chief Litigation and Investigations Counsel or another management-level litigation attorney.

Counsel will advise clients, direct investigations and manage risk arising from various regulatory regimes applicable to the global medical technology industry, including but not limited to global anticorruption laws, the U.S. Anti-Kickback Statute, the Stark Law, the False Claims Act, antitrust law and consumer protection laws. Counsel will provide legal advice to help mitigate risks and maintain compliance while providing legal support to Medtronic’s Operating Units and Regions. Counsel will manage litigation with or relating to government entities, including under the False Claims Act. Counsel will also serve as a company liaison with federal, state and local law enforcement and provide legal advice to the Global Security, Internal Audit and Global Compliance organizations. This individual must possess strong legal and communication skills and the ability to interact effectively with a variety of individuals in cross-functional roles in the organization. This role requires a high level of professionalism and responsiveness to business stakeholders in a large, dynamic and fast-paced environment.

Location: Minneapolis-St. Paul, Minnesota preferable but open to remote work or other Medtronic location for a preferred candidate.
A Day in the Life

Responsibilities may include the following and other duties may be assigned.

  • Evaluate and supervise litigation and investigations involving various Medtronic operating units
  • Direct privileged risk assessments, internal investigations or reviews involving litigation, compliance or regulatory issues
  • Hire, supervise and manage outside counsel
  • Develop, manage and meet budgets for efficient and effective management of cases
  • Achieve resolution of litigation and investigations on favorable terms
  • Provide day-to-day work direction and feedback to paralegal and administrative support personnel
  • Consult and collaborate with company strategic business counsel on issues relating to litigation strategy, exposure and risk

Must Have: Minimum Requirements

  • Juris Doctor from nationally recognized law school
  • Licensed to practice law and in good standing under the Bar of at least one state
  • At least eight (8) years of complex litigation/investigations experience

  • Ability to work collaboratively and communicate across a complex organization
  • Ability to establish credibility and develop strong working relationships with clients
  • Capable of inspiring trust and confidence of clients, including senior management
  • Ability to work on multiple projects at the same time
  • Proven ability to litigate as part of a large, multidisciplinary team
  • Strong experience and skill with management of e-data and e-discovery issues
  • Superior common sense and judgment
  • Exceptional advocacy and negotiating skills
  • Analytical risk identification, evaluation and management skills
  • Flexibility, adaptability, responsiveness and collegiality
  • Experience managing or directing, or serving as outside counsel
  • Medical or scientific background or knowledge
