Discrimination Law Supervisor

Up to $102,583/annually

This position will supervise workplace nondiscrimination and harassment investigations and analyze complex reasonable accommodation requests to ensure MnDOT meets their obligation for effective response to employees, applicants, and complaints of discrimination, discriminatory harassment, and reasonable accommodation requests.
Coordinate all aspects of MnDOT’s response to charges of discrimination filed with agencies (Equal Employment Opportunity Commission and the MN Department of Human Rights) to ensure effective, thorough, and timely responses. Provides in-depth legal analysis of issues and claims, prepares MnDOT’s position statement ensuring legal/substantive defenses are raised, and responds to agency subpoenas and information requests. Additionally, provides counsel to management on employment discrimination laws, state personnel laws and rules, and MN Government Data Practices Act.

MINIMUM QUALIFICATIONS
To qualify, applicants must have:
- Juris Doctorate degree from an ABA accredited law school; and
- Active license to practice law in the State of Minnesota.
AND
- Three (3) years of experience supervising professionals conducting workplace investigations; OR
- Four (4) years of advanced professional experience conducting workplace investigations.
Information on the candidate’s resume must also include:
- Experience applying state and federal civil rights statutes, state, and federal case law, such as: MN Human Rights Act, Women’s Economic Security Act, MN’s worker’s compensation statute and rules, Americans with Disabilities Act, Age Discrimination in Employment Act, Title VII of the Civil Rights Act, Family Medical Leave Act, and Equal Pay Act.
- Experience analyzing and researching case law, writing, and communicating clear and concise findings in plain language to governing bodies, managers, supervisors, and staff.
- Experience applying investigative strategies and methods to execute different interview strategies dependent on the discrimination allegations.
