What You’ll Do
Attorneys at Dakota County are assigned to handle the prosecution of criminal cases; or to provide civil legal services to Dakota County departments and provide legal representation to and on behalf of Dakota County; and other responsibilities as determined by the County Attorney. Duties & Responsibilities

1. Provide advice to law enforcement personnel, child protection workers, adult protection workers, and others regarding their legal authority, responsibilities, and potential liabilities associated with the investigation of criminal activity.
2. Review investigative reports pertaining to criminal activity to determine the appropriateness of a criminal prosecution.
3. Comply with Dakota County Attorney charging and disposition guidelines for the charging and resolution of matters referred to the office for prosecution.
4. Draft complaints, petitions, warrants, motions, memoranda, findings, orders, stipulations, appellate briefs, and post-conviction memoranda in support of an investigation of criminal activity and related prosecution(s).
5. Prepare assigned cases for contested hearings, trials or appellate arguments.
6. Meet with victims and/or witnesses of criminal activity for the purposes of explaining law, court rules, court procedures, evidentiary rules, and case dispositions.
7. Represent the State of Minnesota and Dakota County in various state and federal courts at pretrial, trial, sentencing, appellate hearings, and post-conviction proceedings related to the prosecution of criminal activity.
8. Provide training for law enforcement agencies, social workers and others regarding applicable developments in the law.
9. Attend staff meetings and other required meetings.
10. Perform other duties as assigned by the Criminal Division Head, Assistant Criminal Division Head, Chief Deputy, or County Attorney.

Work Environment

Location & ScheduleCurrently this is a hybrid position that offers a mix of telework and in-person work at our Judicial Center in Hastings, MN. Work is performed Monday through Friday during regular business hours (8:00 a.m. to 5:00 p.m.)

What You'll Do
County Attorneys in the Civil Division of the Dakota County Attorney's Office represent the interests of Dakota County in civil legal matters by providing legal services to the county board and county departments, representing Dakota County in many types of civil litigation; drafting and reviewing policies and contracts, advising the county board and departments on legal compliance issues and other responsibilities as determined by the County Attorney. Under minimal supervision, the Attorney II/III/IV performs work of varied and moderately complex difficulty in civil or criminal law.

7. Provide training to Dakota County department personnel including explaining laws, court rules, court procedures, evidentiary rules, and case dispositions.
8. Provide training and mentoring to less experienced professional and paraprofessional staff within the Dakota County Attorney's Office.
9. Attend staff and other required meetings.
10. Attend continuing legal education courses.
11. Perform other duties as assigned by Civil Division Head, Chief Deputy, First Assistant or County Attorney.

Notice of Position Vacancy
Position Title: Short-Term Law Clerk to U.S. Bankruptcy Judge Kesha L. Tanabe
(Full-time)
Position Available: January 2024

Salary: $74,973 - $138,913 (based on qualifications)
Tenure: 9 months with the possibility of renewal.
This is a full-time, 40 hour per week position. Preference will be given to applications received on or before December 29, 2023. This is a hybrid position.
POSITION DEFINITION
The United States Bankruptcy Court for the District of Minnesota is recruiting a Short-Term Law Clerk to Judge Kesha L. Tanabe. A Law Clerk to a United States Bankruptcy Judge performs substantive review, research, and writing on matters pending before the Court.
REPRESENTATIVE DUTIES INCLUDE:
Reviews complaints, petitions, motions, and other pleadings that come before the Court to determine the issues involved and the basis for relief;
Reviews dockets of pending litigation and monitors progress;
Screens motions and drafts orders for judge’s review;
Performs legal research;
Identifies issues before the Court and makes recommendations;
Provides information to the judge in connection with pending litigation;
Drafts bench memos for the judge’s consideration;
Proofreads orders and opinions, verifying citations;
Maintains liaison between the Court and litigants;
Communicates with counsel, court officials, and litigants regarding procedural requirements;
Keeps abreast of changes in the law and briefs the judge;
Assists the judge during courtroom proceedings;
Shares in the administrative tasks of chambers; and
Performs other duties as assigned.
MINIMUM QUALIFICATION REQUIREMENTS:
· Graduate of a law school of recognized standing by the American Bar Association or the Association of American Law Schools; and,
· Experience on a law journal, moot court, externship or clinical program; or
· Prior coursework or research related to bankruptcy, consumer protection or secured transactions.
PREFERRED QUALIFICATIONS:
· Strong legal research skills and ability to communicate effectively, both orally and in writing
· Good organizational, computer, computer-assisted legal research, and word processing skills
· Discretion and confidentiality, adherence to the court’s ethical rules
· Maturity and reliability, and responsibility
· Ability to collaborate effectively in a team-based environment
· Demonstrated ability to work in a self-directed hybrid or remote work environment
· Ability to manage and prioritize multiple tasks and deadlines
· Previous work experience for a bankruptcy judge, bankruptcy law firm or direct legal services
BACKGROUND CHECK
This is a sensitive position within the Judiciary. The selected candidate will be required to undergo an FBI fingerprint check through the FBI Criminal Justice Information Services Division. Appointment to this position is provisional, and retention depends upon a favorable suitability determination based on the results of the fingerprint check.
BENEFITS
The United States Bankruptcy Court is a part of the Judicial Branch of the United States Government. Employees of the United States Bankruptcy Court serve under “Excepted Appointment” and are considered “At-Will” employees.
Because the anticipated term of this appointment is less than one year, this position will be eligible for health and commuter benefits and for supplemental dental and vision coverage, but will NOT BE ELIGIBLE for life insurance, the court’s flexible benefits program (ex: Health Care Reimbursement Account) or participation in the FERS retirement system or the Thrift Savings Plan.
The successful applicant will earn 4 hours of annual leave and 4 hours of sick leave for every complete two-week pay period worked.

MINIMUM QUALIFICATIONS
To qualify, applicants must have:
- Juris Doctorate degree from an ABA accredited law school; and

General Duty Statement
This position performs advanced professional work and a wide variety of complex to highly complex legal assistant services to attorneys in the Civil Division. Duties include gathering, organizing, and summarizing documentary evidence and relevant information in complex to highly complex civil processes and making recommendations based on findings. Duties also include creating, processing and/or drafting complex legal forms and documents. This position acts as a liaison with other City departments, outside agencies, and outside attorneys.
Primary Responsibilities:
A wide range of public sector real estate, land use, and development-related matters including the following:
- Conduct project intake and prepare/organize file information and file management.
- Prepare correspondence, documents, and materials that relate to real estate, lending, leasing, and licensing transactions.
- Compile and summarize relevant materials, identify potential issues, and propose recommendations for use by attorneys.
- Calendar and monitor milestones and critical dates.
- Assist with due diligence process.
- Assist with city, state, and federal compliance determinations.
- Maintain repository of template documents and city attorney opinions and update as needed.
- Work with city staff, outside counsel, title companies, lenders and other parties.
- Prepare closing checklists, closing documents, and manage closing binder.
- Prepare transaction memoranda.
- Review title and survey documents.
- Record real estate documents and financing statements.
- Prepare resolutions and board reports relating to zoning and other matters for the City Council and various boards and commissions.
- Assist in research, writing, editing, and proofreading real estate documents, contracts, and other legal documents.
- Perform property record tract index research as needed.
- Work with attorneys and staff to support day-to-day legal needs.

Requirements
- A Bachelor's Degree;

Information Specific to this Position:
This position performs wide-ranging, expert level, highly-complex professional legal work in the Civil Division. Nature of Work
The Assistant City Attorney I provides professional legal services on behalf of the City while working under the direction of the City Attorney or Deputy City Attorney. Duties include representing the City in criminal cases; conducting legal research; preparing and maintaining criminal files; and advising or issuing legal opinions to City officials or other appropriate persons. Job Summary

The Office is currently seeking an Assistant Attorney General (“AAG”) to serve as the attorney manager of the Wage Theft Division, which is housed in the Consumer Protection Section of the Office. As the Division Manager, you will manage a division of
AAGs and investigators who lead enforcement actions focused on unlawful wage and hour practices that target vulnerable and low-wage workers across the state, including immigrant communities and people of color. In this position, you would be at the forefront of cutting-edge labor enforcement work that has a direct, measurable impact on the lives of Minnesota workers.
Wage theft attorneys can expect to participate in high-profile investigations and litigation in industries such as the gig economy, hospitality and restaurants, construction, healthcare and agriculture. Such cases include, for example: State v. Shipt, Inc. (allegations of misclassification of gig-economy “shoppers” as independent contractors); In re Bartmann Companies (failure to pay overtime and back wages to restaurant employees); and State v. Property Maintenance & Construction, LLC, et al. (allegations of intimidating construction workers from cooperating with investigation).
If you are offered this position, you can expect to have a great deal of responsibility for and control over your daily work while also leading a team of attorneys who complement and cover for each other. As the Division Manager you will lead your own investigations and guide AAGs and investigators through all aspects of civil litigation, including discovery, motion practice, oral argument, and resolving cases through trial or negotiated settlements. The Division’s attorneys and investigators are all expected to manage their caseloads to ensure matters are moving expeditiously. They are also expected to engage in public education and outreach to impacted communities, stakeholders, and advocates. As a result, you will need to be able to interact with and understand persons from diverse backgrounds, languages, and cultures.
This position offers engaging, interesting, and fulfilling work. The attorney division manager is responsible for overseeing the work of the division, including balancing the staffing needs of various investigations and cases with the interests and experience of AAGs in particular subjects and industries. The attorney division manager is also tasked with management of the professional development of the division’s AAGs and investigators, and ensuring ongoing training, leadership opportunities, and mentorship opportunities to support their growth.
A successful candidate in this position demonstrates commitment to public service, has strong management skills, is detail-oriented, creative, a problem solver, has a strong initiative and work ethic, and enjoys working within a fast-paced team-oriented community.

Minimum Qualifications
- Graduation from a law school accredited by the ABA
- Licensed to practice in the State of Minnesota or ability to obtain licensure within 90 days of hire
- Outstanding writing, research, and oral advocacy skills (submission of a writing sample is required)
- Six or more years of litigation or administrative law experience.
- Exceptional interpersonal skills and the ability to work collaboratively with colleagues and stakeholders
- Experience using electronic files, case management tools, and e-discovery platforms
- Management skills for overseeing attorneys, analysts, other professionals, litigation, and/or investigations
- Past work or similar experience with diverse communities
Preferred Qualifications
- Five or more years of past experience in an attorney manager or law enforcement role
- Wage Theft or Labor Law experience
- Experience:
- handling matters involving wage theft issues and/or knowledge of state and federal labor regulation
- investigating and building cases for litigation, including government civil law enforcement actions, consumer protection matters, or criminal prosecutions
- Experience or academic background in concepts relevant to wage theft, including employment law, economics, business, or other related fields
- Second-language proficiency in languages spoken by Minnesota’s immigrant communities

Duties and Responsibilities:
Investigation and Complaint Resolution 85%
- Investigate complaints of discrimination, sexual misconduct, nepotism, and related retaliation to determine whether University policy violations occurred.
- Draft clear and accurate reports of investigative findings and make recommendations for responsive action.
