General Duty Statement

The Saint Paul City Attorney's Office is a premier public law office of 90-plus legal professionals and support staff practicing in all areas of municipal law including criminal prosecution, civil litigation, municipal governance, contract and procurement, code and licensing enforcement, planning and zoning, real estate, and economic development.
 
The Saint Paul City Attorney's Office is currently accepting applications for a full-time, senior assistant city attorney position in its Civil Division. Duties will primarily include civil transactional and regulatory work and may also include litigation or other work as assigned.
 
Information Specific to this Position:
This position performs wide-ranging, expert level, highly-complex professional legal work in the Civil Division. The worksite for this position is at the St. Paul City Attorney's Office located in downtown Saint Paul. While some telework may be possible upon approval of the City Attorney, this position is not a remote position.
 
Responsibilities may include, but are not limited to:

  • Provides general legal services and expert legal advice to the City Council, the Mayor’s Office, various City departments, divisions, offices, authorities, boards, commissions and committees.
  • Staffs meetings of the Saint Paul City Council, Housing and Redevelopment Authority, Planning Commissions and other various boards and commissions of the City.
  • Drafts ordinances, resolutions, rules and policies.
  • Prepares legal opinions or memoranda.
  • Drafts and negotiates contracts, which may include real estate documents such as development agreements, easements, deeds, restrictive covenants, subordination agreements, leases, and loan and grant agreements.
  • Advises on Federal, State and City compliance requirements.
  • Represents the City of Saint Paul and its various departments, boards, and commissions in administrative cases and related matters.
  • Plans, organizes, mentors, and leads the work of other employees in varying positions within the Civil Division as requested by the City Attorney, Deputy City Attorney, or Supervising Attorney.

Salary Range: The 2024 starting rate of pay is $99,041 annually with advancement to $145,648. 

Nature of Work
The Assistant City Attorney I provides professional legal services on behalf of the City while working under the direction of the City Attorney or Deputy City Attorney. Duties include representing the City in criminal cases; conducting legal research; preparing and maintaining criminal files; and advising or issuing legal opinions to City officials or other appropriate persons. An Assistant City Attorney I is responsible for prosecution of criminal offenses occurring within the jurisdiction of the City of Rochester and City Attorney's Office.   An Assistant City Attorney I may also assist with select civil related projects or defined civil topics, at the discretion and direction of the City Attorney.

The Assistant City Attorney reports directly to the Deputy City Attorney – Criminal Division.

*Represent the City and the State in the prosecution of criminal offenses. 

  • Serve as prosecuting attorney at all stages of criminal cases including arraignment, pre-trial, trial, sentencing, and probation violations before the District Court and the Court of Appeals.
  • Review criminal reports and body camera footage from law enforcement agencies to determine charging decisions that constitute criminal violations.
  • Draft formal complaints and warrants.
  • Conduct litigation on behalf of the City and  State.
  •  Process and draft criminal litigation documents. 
  • Assemble evidentiary matters, conduct legal research, negotiate settlements, and discern other professional actions relative to matters involved in litigation.
  • Undertake plea negotiations in criminal cases. 
  • Consult established guidelines to judge suitable plea alternatives in view of evidence and nature of pending charges. 
  • Prepare plea petitions as appropriate.
  • Attend meetings and supply professional legal expertise and guidance to  boards and committees.
  • Collaborate among all entities within the judicial system to establish policy and procedure in response to changing laws and regulations.

*Serve as legal advisor for the City

  • Advise police officers concerning criminal law enforcement issues. 
  •  Update, inform and train police officers concerning new laws and investigation procedures.
  • Respond to inquiries from the public, which includes but is not limited to explaining ordinances, municipal procedures, state and federal laws and regulations, or other legal issues affecting the City.
  • Research, prepare, and issue legal opinions and advice involving criminal law for City departments, boards, commissions, and officials (under the direction of the City Attorney).
  • Assist with select civil related projects or defined civil topics, at the discretion and direction of the City Attorney,

*ESSENTIAL FUNCTIONSMINIMUM QUALIFICATIONS

Education and Experience
Graduation from an accredited law school under the Rules of Minnesota Supreme Court with a Juris Doctor Law Degree.
A license or ability to be immediately licensed to practice law within the State of Minnesota.

  • Establish and maintain effective working relationships with members of the City Attorney's office, other City department staff, external justice partners, and the public. 
  • Demonstrate flexibility and adaptability.
  • Maintain accurate and complete records; prepare clear and detailed reports. 
  • Efficiently use office equipment such as personal computer, word processor, copier and fax machine.

PHYSICAL AND ENVIRONMENTAL CRITERIA

The Office is currently seeking an Assistant Attorney General in the Residential Utilities
Division of the Office. The attorney’s primary caseload will involve advocating for
residential and small business ratepayers before the Public Utilities Commission and

 As an Assistant Attorney General, you will work alongside analysts to advocate for
policies that will improve the lives of Minnesota’s residential and small business
ratepayers receiving electric, gas, and landline telephone service. The division primarily
appears before the Public Utilities Commission and the Office of Administrative
Hearings. The position may also provide opportunities to appear before Minnesota’s
appellate courts and to participate in formal and informal stakeholder groups addressing
areas of emerging public utility policy. 

Minimum Qualifications
 Graduation from a law school accredited by the ABA and licensed to practice in
the State of Minnesota or ability to obtain licensure within 90 days of hire 
 Outstanding oral and written communication skills (a writing sample of up to
five pages is required to be attached to a cover letter) 
 Ability to: 
o use electronic files and case management tools
o multitask by managing an active caseload and meeting tight deadlines 
o work in an inclusive, creative, and collaborative work environment
o contribute positively to a team and interact successfully with co-workers,

General Description of Duties: 
This position will involve prosecuting individuals charged with petty misdemeanor, misdemeanor, and gross misdemeanor offenses. Typical work performed includes:
 

  • Screening of cases for criminal charges by reviewing and evaluating reports from law enforcement, assessing evidentiary issues and the merits of cases, and recommending approval of or declining of charges.
  • Representing the City by preparing for and making appearances at arraignments, pretrial hearings. jury trials, sentencing, and other court proceedings; keeping affected parties informed as to case status; negotiating resolution of cases, and recommending disposition of cases.
  • Conducting case investigations by identifying and researching legal issues, interviewing victims and witnesses, and obtaining evidence from sources such as phone records, business records, video or audio tapes, background searches, and other evidentiary materials.
  • Drafting, filing, and/or submitting criminal complaints, memoranda, discovery requests, appeals, proposed court orders, pleadings, motions, letters, and other legal documents.
  • Drafts ordinances, resolutions, rules, and policies.
  • Plans, organizes, mentors, and leads the work of lower-level employees within the Criminal Division as requested by the City Attorney, Deputy City Attorney, or Supervising Attorney.
  • Leads criminal prosecution activities and provides expert legal advice to the City Council, the Mayor's Office, City departments, boards, commissions, and committees.

Job Summary

The Office is currently seeking an Assistant Attorney General (“AAG”) to serve as the attorney manager of the Wage Theft Division, which is housed in the Consumer Protection Section of the Office.  As the Division Manager, you will manage a division of

AAGs and investigators who lead enforcement actions focused on unlawful wage and hour practices that target vulnerable and low-wage workers across the state, including immigrant communities and people of color.  In this position, you would be at the forefront of cutting-edge labor enforcement work that has a direct, measurable impact on the lives of Minnesota workers.

Wage theft attorneys can expect to participate in high-profile investigations and litigation in industries such as the gig economy, hospitality and restaurants, construction, healthcare and agriculture.  Such cases include, for example:  State v. Shipt, Inc. (allegations of misclassification of gig-economy “shoppers” as independent contractors); In re Bartmann Companies (failure to pay overtime and back wages to restaurant employees); and State v. Property Maintenance & Construction, LLC, et al. (allegations of intimidating construction workers from cooperating with investigation).

If you are offered this position, you can expect to have a great deal of responsibility for and control over your daily work while also leading a team of attorneys who complement and cover for each other.  As the Division Manager you will lead your own investigations and guide AAGs and investigators through all aspects of civil litigation, including discovery, motion practice, oral argument, and resolving cases through trial or negotiated settlements.  The Division’s attorneys and investigators are all expected to manage their caseloads to ensure matters are moving expeditiously.  They are also expected to engage in public education and outreach to impacted communities, stakeholders, and advocates.  As a result, you will need to be able to interact with and understand persons from diverse backgrounds, languages, and cultures.

This position offers engaging, interesting, and fulfilling work.  The attorney division manager is responsible for overseeing the work of the division, including balancing the staffing needs of various investigations and cases with the interests and experience of AAGs in particular subjects and industries.  The attorney division manager is also tasked with management of the professional development of the division’s AAGs and investigators, and ensuring ongoing training, leadership opportunities, and mentorship opportunities to support their growth.

A successful candidate in this position demonstrates commitment to public service, has strong management skills, is detail-oriented, creative, a problem solver, has a strong initiative and work ethic, and enjoys working within a fast-paced team-oriented community.

This position is eligible for a hybrid work environment.

Minimum Qualifications

  • Graduation from a law school accredited by the ABA
  • Licensed to practice in the State of Minnesota or ability to obtain licensure within 90 days of hire
  • Outstanding writing, research, and oral advocacy skills (submission of a writing sample is required)
  • Six or more years of litigation or administrative law experience.
  • Exceptional interpersonal skills and the ability to work collaboratively with colleagues and stakeholders
  • Experience using electronic files, case management tools, and e-discovery platforms
  • Management skills for overseeing attorneys, analysts, other professionals, litigation, and/or investigations
  • Past work or similar experience with diverse communities

Preferred Qualifications

  • Five or more years of past experience in an attorney manager or law enforcement role
  • Wage Theft or Labor Law experience
  • Experience:
    • handling matters involving wage theft issues and/or knowledge of state and federal labor regulation
    • investigating and building cases for litigation, including government civil law enforcement actions, consumer protection matters, or criminal prosecutions
  • Experience or academic background in concepts relevant to wage theft, including employment law, economics, business, or other related fields
  • Second-language proficiency in languages spoken by Minnesota’s immigrant communities
