General Duty Statement

This position performs advanced professional work and a wide variety of complex to highly complex legal assistant services to attorneys in the Civil Division. Duties include gathering, organizing, and summarizing documentary evidence and relevant information in complex to highly complex civil processes and making recommendations based on findings. Duties also include creating, processing and/or drafting complex legal forms and documents. This position acts as a liaison with other City departments, outside agencies, and outside attorneys.
 
Primary Responsibilities: 
A wide range of public sector real estate, land use, and development-related matters including the following:

  • Conduct project intake and prepare/organize file information and file management.
  • Prepare correspondence, documents, and materials that relate to real estate, lending, leasing, and licensing transactions.
  • Compile and summarize relevant materials, identify potential issues, and propose recommendations for use by attorneys.
  • Calendar and monitor milestones and critical dates.
  • Assist with due diligence process.
  • Assist with city, state, and federal compliance determinations.
  • Maintain repository of template documents and city attorney opinions and update as needed.
  • Work with city staff, outside counsel, title companies, lenders and other parties.
  • Prepare closing checklists, closing documents, and manage closing binder.
  • Prepare transaction memoranda.
  • Review title and survey documents.
  • Record real estate documents and financing statements.
  • Prepare resolutions and board reports relating to zoning and other matters for the City Council and various boards and commissions.
  • Assist in research, writing, editing, and proofreading real estate documents, contracts, and other legal documents.
  • Perform property record tract index research as needed.
  • Work with attorneys and staff to support day-to-day legal needs.

Requirements

  • A Bachelor's Degree;
  • Paralegal Certification from an accredited program;
  • Four years of experience as a Legal Assistant, two years of which must have been at the intermediate level of professional work, providing legal assistant services of moderate complexity and variety to attorneys.

Continued employment as a Legal Assistant III is contingent upon maintaining the Paralegal Certification.

Preferred Qualifications: Four years of experience supporting a real estate legal practice. Understanding of municipal real estate, development, and finance practices including local, state, and federal funding.

The City of Duluth seeks an Assistant City Attorney to join our Civil Division team!

The Office of the City Attorney is committed to providing excellent legal services, advice and representation to the City, City Authorities, Commissions and officials and staff, and honoring the highest principles of the legal profession.

At the direction of the City Attorney, and under the general supervision of the Deputy City Attorney, Civil Division, the Assistant City Attorney position performs professional legal work, primarily in the areas of economic development, land use and zoning, real estate, environmental, transactional and contract law.   Experience in these or related subject areas is preferred.

Essential Duties & Responsibilities (other duties may be assigned)

  • Advise on civil legal issues at all stages of transactional matters, including negotiating, drafting and reviewing contracts and related documents, assist in drafting and reviewing ordinances and resolutions.
  • Perform general legal research and prepare written and oral opinions on various legal issues for City Council, City departments, City Authorities, and various boards and commissions.
  • Establish and maintain positive working relationships.
  • Assist with employment-related matters including hiring, disciplining, and employment benefits.
  • Advise on labor law issues and attend labor negotiations. 
  • Represent the City Attorney’s Office at various City Council, Authority, and board and commission meetings and render legal advice on agenda items.
  • Represent the City, its Authorities and their officers and employees in court and administrative hearings as required.
  • Represent the City, its Authorities and their officers and employees in negotiations with outside parties as required.
  • Respond to inquiries from various City departments, Authorities, and boards and commissions.
  • Assist with responding to data practices requests.
  • Periodic work onsite at night and/or on weekends may be required.
  • Perform other duties as assigned.

Minimum Qualifications

  • Must be admitted to practice law in Minnesota and in good standing. 
  • General understanding of principles and practices related to municipal law as applicable to assigned areas of responsibility.
  • Knowledge of local ordinances, state laws, established precedents, and legal reference sources as well as methods of legal research.
  • Ability to deal respectfully and effectively with people from all cultures.
  • Excellent oral and written communication skills.

The Office is currently seeking an Assistant Attorney General (AAG) in the Human Services Division of the Office.

The Human Services Division provides litigation services and legal counsel to the Department of Human Servies (DHS), the state’s largest agency. AAGs in the division represent DHS in a broad range of cases involving health care, licensing, children and family services, and civil commitment. AAGs regularly handle cases in state and federal district court, state and federal appellate courts, and the Office of Administrative Hearings. Human Services Division AAGs have regularly argued at the Minnesota Court of Appeals, the Minnesota Supreme Court, and the Eighth Circuit. Attorneys also frequently appear in evidentiary hearings and trials in a variety of forums.

A successful candidate in this position will be able to:

  • Represent DHS in different forums – from state and federal courts to administrative agency appeals
  • Work on all aspects of civil litigation, from initial answer or Rule 12 motion, through discovery, motion practice, mediation, trial, and appeal
  • Work collaboratively with attorneys both within the division and at DHS
  • Work in an inclusive, creative, and collaborative work environment
  • Travel occasionally throughout Minnesota, as cases can be venued anywhere in the state

Minimum Qualifications

  • Graduation from a law school accredited by the ABA and licensed to practice in the State of Minnesota (or able to obtain licensure within 90 days of hire)
  • Outstanding writing, research, and oral communication/advocacy skills
  • Strong analytical skills
  • Exceptional interpersonal skills and the ability to interact successfully with clients, stakeholders, and members of the public
  • Detail-oriented and proven ability to multitask, including by managing an active caseload or multiple projects and meeting tight deadlines
  • Commitment to public service
  • Ability to travel to counties across the state

Position Title:                                 Law Clerk to U.S. Bankruptcy Judge (Full‑time, Term position)

This is a full‑time, 40 hour per week position.

POSITION DEFINITION

The United States Bankruptcy Court for the District of Minnesota is recruiting a Term Law Clerk to Judge William J. Fisher. A Law Clerk to a United States Bankruptcy Judge performs substantive review, research, and writing on matters pending before the Court.

REPRESENTATIVE DUTIES INCLUDE:

Reviews complaints, petitions, motions, and other pleadings that come before the Court to determine the issues involved and the basis for relief;

Reviews dockets of pending litigation and monitors progress;

Screens motions and drafts orders for judge’s review;

Performs legal research;

Identifies issues before the Court and makes recommendations;

Provides information to the judge in connection with pending litigation;

Drafts bench memos for the judge’s consideration;

Proofreads orders and opinions, verifying citations;

Maintains liaison between the Court and litigants;

Communicates with counsel, court officials, and litigants regarding procedural requirements;

Keeps abreast of changes in the law and briefs the judge;

Assists the judge during courtroom proceedings;

Shares in the administrative tasks of chambers; and

Performs other duties as assigned.

Minimum Qualification Requirements:

·       Graduate of a law school of recognized standing by the American Bar Association or the Association of American Law Schools; and,

·       The following attributes:

--Good academic record; and

‑-Experience on the editorial board of a law review; or

‑‑Demonstrated proficiency in legal studies, which in the opinion of the Court, is equivalent to one of the above.

PREFERRED QUALIFICATIONS:

·       A strong academic background

·       Excellent legal research skills and ability to communicate effectively, both orally and in writing

·       Exceptional organizational, computer, computer‑assisted legal research, and word processing skills

·       Ability to maintain confidentiality, uphold the court’s ethical rules and exhibit good judgment, maturity, dependability and responsibility

·       Ability to work effectively and harmoniously with others in a team‑based environment

·       Ability to manage and prioritize time and tasks and meet all deadlines

·       Previous experience as a federal law clerk or bankruptcy attorney is highly desirable

BACKGROUND CHECK

This is a sensitive position within the Judiciary. The selected candidate will be required to undergo an FBI fingerprint check through the FBI Criminal Justice Information Services Division. Appointment to this position is provisional, and retention depends upon a favorable suitability determination based on the results of the fingerprint check.

The United States Bankruptcy Court is a part of the Judicial Branch of the United States Government. Employees of the United States Bankruptcy Court serve under “Excepted Appointment” and are considered “At‑Will” employees. Benefits include:

Job Summary

The compensation attorney for the Department of Employment & Economic Development (DEED) will preside over and conduct unemployment insurance hearings as an unemployment law judge for single and multi - party matters, under Minnesota Statutes, Chapter 268. The compensation attorney will issue written findings of fact, reasons for decision, and conclusions of law and other orders or subpoenas as appropriate. This position requires making decisions quickly and writing clear and well-reasoned decisions supported by the law within five (5) days of holding the hearing. The current caseload is approximately twenty-five (25) hearings per week. The compensation attorney needs strong communication skills to effectively control proceedings with single and multiple parties, including employers, employees, attorneys, and other witnesses, including the ability to clearly communicate complex legal concepts to unrepresented parties. The judge must also be highly skilled at questioning witnesses. The compensation attorney will also issue decisions on requests for reconsideration that are the department's final decision and are directly appealable to the Minnesota Court of Appeals and will perform other duties as assigned.

The compensation attorney will be trained on unemployment insurance law, the unemployment insurance computer application system, and will be provided judicial training. The compensation attorney will be expected to navigate the computer application system. The compensation attorney must be highly skilled in interpersonal relations and will be expected to conduct hearings inconformity with applicable law and that meet constitutional requirements, under Minnesota Statutes, section 268.105. The compensation attorney must also adhere to federal quality guidelines and Department expectations when conducting hearings. Substantive issues in hearings include eligibility for unemployment benefits under state and federal programs, the effect of benefits paid on employer taxes and reimbursing accounts, determination of the proper employer tax rate, eligibility for federal and state extensions and other programs, the effect of receipt of earnings, severance pay, workers' compensation benefits, retirement benefits, and other payments, and various other issues.

This position is expected to last up to three (3) years.

Qualifications

Minimum Qualifications

To receive credit for your education and experience, your resume should clearly describe how you meet each minimum and/or preferred qualification listed, including dates of employment.

Graduation from a law school accredited by the ABA (American Bar Association), licensed, and in good standing to practice law in the State of Minnesota prior to appointment. 

Applicants that meet the above minimum qualification will be further evaluated on the following:

Experience in meeting deadlines.

Ability to analyze statutes and apply the facts to the facts to the law so as to make an accurate legal decision and write using plain language. 

Ability to receive supervisory feedback and proactively incorporate into hearings and decisions.

Ability to navigate the computer application system and draft own decisions. 

Maintain professionalism and respect when engaging with both internal colleagues and external clients, fostering positive working relationships and client trust.

Preferred Qualifications

Experience clerking for a state or federal judge.

Labor law or employment law experience and experience in representing clients in or presiding over unemployment benefit hearings.

Courtroom/trial experience including voir dire or direct or cross-examination of witnesses, deposition or arbitration experience, and experience as a mediator.

Experience that demonstrates the skill set necessary to issue legal decisions that include the legal issues to be decided, the findings of fact, reason for decision, and legal conclusion, within five (5) calendar days of holding the hearing.

Fluency in another language, especially Spanish, Hmong, Somali, Khmer, Russian, Lao, Vietnamese, or Karen.

The Office is currently seeking an Assistant Attorneys General (AAG) to join the Antitrust Division which is housed in the Consumer Protection Section of the Office.  As an antitrust attorney, you will have the opportunity to protect healthy competition and fair markets for the benefit of all Minnesotans by enforcing state and federal antitrust laws.  These laws prohibit conduct that interferes with healthy business competition, such as monopoly abuse, anticompetitive mergers or acquisitions, and anticompetitive agreements not to compete.  In this position, you would be at the forefront of a revitalized era of antitrust enforcement and your work will have a direct, measurable impact on the lives of Minnesotans.

A successful candidate will have the opportunity to support the mission of the office by participating in high-profile antitrust investigations and litigation in industries such as health care and agriculture that play a major role in Minnesota’s economy. They will have the opportunity to work closely with other state and federal antitrust enforcement agencies.  Such cases include, for example:  In re Generic Pharmaceuticals Antitrust Pricing Litigation – MDL 2724 (allegations of illegal price fixing by dozens of generic drug manufacturers for hundreds of generic drugs that treat cancer, diabetes, MS, and other conditions); FTC, et al. v. Syngenta Crop Protection AG, et al. (illegal suppression of competition from generic pesticide manufacturers through branded manufacturers use of “loyalty programs”); and the enforcement of the new Health Care Entity Transaction Law.

This position offers engaging, interesting, and fulfilling work well suited to the experience level and interests of individual AAGs.  The Office balances the staffing needs of various investigations and cases with the interests of AAGs in particular subjects and industries.  AAGs are encouraged to take on more responsibility as their careers progress, and will receive ongoing training, leadership opportunities, professional development, and mentorship opportunities to support their growth.

The Office is currently seeking an Assistant Attorney General (“AAG”) to serve as the attorney manager of the Residential Utilities Division, which is housed in the Consumer Protection Section of the Office.  As the division manager, you will manage a division of

AAGs (currently three) and analysts (currently three) who advocate for residential and small business consumers in matters involving natural gas, electric, and telephone utility service in administrative and litigation proceedings and before the Legislature.  The Division also investigates potential violations of consumer protection laws and takes enforcement action in appropriate matters.

RUD attorneys can expect to participate in high-profile rate proceedings before the Public Utilities Commission and the state appellate courts.  Such cases include, for example:  the Xcel Energy Electric rate case (helped reduce a proposed $678 million rate increase by $372 million) and the investigation into costs associated with the February 2021 natural gas price spike (helped save ratepayers almost $60 million in imprudently incurred gas costs during Winter Storm Uri).

This position offers engaging, interesting, and fulfilling work.  The attorney division manager is responsible for overseeing the work of the division, including balancing the staffing needs of various investigations and cases with the interests and experience of AAGs in particular subjects and industries.  The attorney division manager is also tasked with management of the professional development of the division’s AAGs and analysts, and ensuring ongoing training, leadership opportunities, and mentorship opportunities to support their growth.

If you are offered this position, you can expect to have a great deal of responsibility for and control over your daily work while also working with teams of attorneys and analysts who complement and cover for each other.  The division’s attorneys and analysts are all expected to manage their caseloads to ensure matters are moving expeditiously.  The division’s attorneys and analysts are also expected to engage in public education and outreach to impacted communities, stakeholders, and advocates.

The Office is currently seeking an experienced attorney in the State Agencies Division of the Office.

The State Agencies Division provides litigation and legal counsel to a variety of State agencies including the Minnesota Departments of Health, Labor and Industry, Corrections, Human Rights, and Veterans Affairs.  Attorneys in the division represent agencies in state and federal court litigation including defense of Section 1983 lawsuits, often involving constitutional issues.  Attorneys also handle administrative proceedings for State agencies, including enforcement of labor, health, human rights, and safety laws. 

A successful candidate will have the opportunity to support the mission of the office by:

  • Representing state agencies in a wide variety of forums – from state and federal courts to administrative agency appeals
  • Working on all aspects of civil litigation, including preparing pleadings and briefs, engaging in discovery and motion practice, appearing at court hearings and trials, and handling appeals

Minimum Qualifications

  • Graduation from a law school accredited by the ABA and licensed to practice in the State of Minnesota
  • Two years of civil litigation experience or equivalent
  • Proven ability to litigate independently and make strategic legal decisions on a diverse caseload
  • Outstanding oral and written communication skills (a cover letter with a writing sample is required with application submission)
  • Proven ability to multitask by managing an active caseload and meeting tight deadlines
  • Ability to travel to counties across the state

The legal practice at the Consolidated Legal Center (CLC) Rochester covers a wide variety of issues focusing on correctional law and litigation, either through administrative or litigation channels and includes such matters as inmates' reasonable access to the courts (through access to legal materials, legal correspondence, and attorney-client visits), conditions of confinement, medical care, diet and religious accommodations, housing assignments, hygiene and sanitation, and discipline.  This practice will also include prosecution assistance regarding crimes involving correctional operations, and matters processed through the Federal Tort Claims Act.  Incumbent will work closely with medical staff and the U.S. Attorney's Office in dealing with mental health issues under 18 USC §§ 4241 - 4248.

Job Description: 

The position will provide advice and guidance to all levels of staff at these correctional facilities, including members of the Executive Staff.  The incumbent will be significantly involved in preparing litigation reports and pleadings to various litigation filed against staff and the United States, as well as handle the adjudication of administrative tort claims. The incumbent will also be expected to communicate with defense attorneys, prosecutors, federal courts, and agency officials.  The incumbent must have thorough knowledge of all aspects of BOP policy and practice as he/she may be required to appear in District Court on short notice to explain and advocate the agency's rationale for its correctional management decisions.  
 
This is a primary law enforcement position.  In accordance with 5 U.S.C. 3307, the maximum entry age of 36 has been established for initial appointment to a position in a Bureau of Prisons correctional institution. If you are above the maximum entry age and have prior federal law enforcement coverage, you must submit an SF-50 to verify prior coverage. Qualified Preference Eligible Veterans may be exempt from meeting the maximum age. 
 
The duties of this position may at times require frequent and direct contact with individuals in confinement who are suspected or convicted of serious criminal offenses.  It has also been determined that the duties of this position require experience and knowledge of the on-the-job responsibilities of a primary law enforcement officer working in a detention facility.  A prerequisite requirement of this position is the successful completion of “Institution Familiarization” and, the satisfactory completion of a mandatory course in “Introduction to Correctional Techniques.”   

Because of the nature and mission of this position, it requires "hands-on" understanding of the issues encompassed in working within an institution.  The incumbent may be called on to perform as a law enforcement officer in a correctional environment during training, emergency situations, times of staff shortages, and under any other type of correctional operating crisis.  Specific correctional responsibilities may include custody and supervision of inmates, responding to emergencies and institution disturbances, participating in fog and escape patrols, and assuming correctional officer posts when necessary.  The incumbent may be required to shakedown inmates and conduct visual searches in their work or living area for contraband.  The incumbent must be prepared to use physical control in situations where necessary, such as in fights among inmates, assaults on staff, and riots or escape attempts.

Qualifications: 

Required Qualifications: Applicants must have a J.D. degree, be an active member of the bar (any U.S. jurisdiction), and have at least one (1) year post-JD legal or other relevant experience. 
 
Preferred qualification: Prior experience in correctional law and/or federal civil litigation is desired though not required.

Job Summary

We have multiple tax attorney positions to fill involving individual income taxation, real property taxation and Corporate Franchise taxation. As a Tax Attorney with the Department, you will have the opportunity to work as an advisor on tax policy, and on often times high-profile tax issues that make a real difference in the lives of all Minnesotans.   • Exceptional human relations skills, problem analysis and solving skills; and
  • Substantial experience in performing legal research, writing and analysis on diverse and complex matters.

Staff Attorney 3 Minimum Qualifications:

In addition to the qualifications of the Staff Attorney 2, finalists for a Staff Attorney 3 must also meet the following minimum qualifications: 

  • At least four years of advanced specialist-level knowledge and expertise in several specialized areas of tax law;
  • Ability to solve novel, complex or unique issues and provide insights regarding the tax system as a whole; and
  • Experience in building and maintaining good working relationships with internal/external stakeholders and providing advice to executives.

Preferred Qualifications

  • Knowledge of state statutes, rules and cases in the law related to individual income taxation or property taxation, or corporate franchise taxation.
  • Experience drafting litigation documents, representing clients in formal and informal judicial and administrative proceedings, and appearing in court.
  • Work experience at the Minnesota State Legislature and legislative process, drafting legislation and bill amendments, or testifying at legislative committee.
  • Work experience documenting legislative history, applying the canons of construction and administrative law.
  • Experience with the compliance aspects of both state and federal individual or corporate income tax law.
  • Working knowledge of the Minnesota disclosure laws.
  • Advanced degree such as a Masters of Business Taxation (MBT), Master of Laws in Taxation (Taxation LL.M.) and/or State Bar Real Estate Law certification.

Physical Requirements

Requires occasional moving of articles such as boxes, accounting records, laptop computer, computer monitors, and other office items.

Prior to an offer of employment, a background check will be conducted.  This will include, but is not limited to checking degrees and licensures, criminal history, and tax filing and payment history.  All individual income tax filing and payment obligations must be current prior to interviewing for this position.
