About the Office:
The legal practice at the Consolidated Legal Center (CLC) Rochester covers a wide variety of issues focusing on correctional law and litigation, either through administrative or litigation channels and includes such matters as inmates' reasonable access to the courts (through access to legal materials, legal correspondence, and attorney-client visits), conditions of confinement, medical care, diet and religious accommodations, housing assignments, hygiene and sanitation, and discipline. This practice will also include prosecution assistance regarding crimes involving correctional operations, and matters processed through the Federal Tort Claims Act. Incumbent will work closely with medical staff and the U.S. Attorney's Office in dealing with mental health issues under 18 USC §§ 4241 - 4248.

Job Description:
The position will provide advice and guidance to all levels of staff at these correctional facilities, including members of the Executive Staff. The incumbent will be significantly involved in preparing litigation reports and pleadings to various litigation filed against staff and the United States, as well as handle the adjudication of administrative tort claims. The incumbent will also be expected to communicate with defense attorneys, prosecutors, federal courts, and agency officials. The incumbent must have thorough knowledge of all aspects of BOP policy and practice as he/she may be required to appear in District Court on short notice to explain and advocate the agency's rationale for its correctional management decisions.
This is a primary law enforcement position. In accordance with 5 U.S.C. 3307, the maximum entry age of 36 has been established for initial appointment to a position in a Bureau of Prisons correctional institution. If you are above the maximum entry age and have prior federal law enforcement coverage, you must submit an SF-50 to verify prior coverage. Qualified Preference Eligible Veterans may be exempt from meeting the maximum age.
The duties of this position may at times require frequent and direct contact with individuals in confinement who are suspected or convicted of serious criminal offenses. It has also been determined that the duties of this position require experience and knowledge of the on-the-job responsibilities of a primary law enforcement officer working in a detention facility. A prerequisite requirement of this position is the successful completion of “Institution Familiarization” and, the satisfactory completion of a mandatory course in “Introduction to Correctional Techniques.”
Because of the nature and mission of this position, it requires "hands-on" understanding of the issues encompassed in working within an institution. The incumbent may be called on to perform as a law enforcement officer in a correctional environment during training, emergency situations, times of staff shortages, and under any other type of correctional operating crisis. Specific correctional responsibilities may include custody and supervision of inmates, responding to emergencies and institution disturbances, participating in fog and escape patrols, and assuming correctional officer posts when necessary. The incumbent may be required to shakedown inmates and conduct visual searches in their work or living area for contraband. The incumbent must be prepared to use physical control in situations where necessary, such as in fights among inmates, assaults on staff, and riots or escape attempts.
Qualifications:
Required Qualifications: Applicants must have a J.D. degree, be an active member of the bar (any U.S. jurisdiction), and have at least one (1) year post-JD legal or other relevant experience.
Preferred qualification: Prior experience in correctional law and/or federal civil litigation is desired though not required.
Salary:
Current salary and years of experience will determine the appropriate salary level. The possible salary range, including locality pay adjustments, is GS-12 ($82,830 - 107,680), GS-13 ($98,496 -$128,043) or GS-14 ($116,393 to $151,308).
Travel:
Travel may be required for litigation and/or training purposes.

Job Summary
This posting may be used to fill multiple vacancies. This vacancy is being posted at multiple job class levels: Staff Attorney 1, Staff Attorney 2 or Staff Attorney 3. Final job class will be determined based on successful applicant's qualifications.
We have multiple tax attorney positions to fill involving individual income taxation, real property taxation and Corporate Franchise taxation. As a Tax Attorney with the Department, you will have the opportunity to work as an advisor on tax policy, and on often times high-profile tax issues that make a real difference in the lives of all Minnesotans. Specifically, you will provide legal counsel to the relevant taxing division, the relevant appeals division and the Commissioner's office on questions regarding taxation. This includes drafting legal memos, department publications (Rulemaking, Revenue Notices, Fact Sheets, Industry Guides, FAQ's, and Forms) and provide Department trainings as needed. During the legislative session, you will also draft tax legislation, testify in tax committee and act as a resource regarding tax administration for legislators and their staff. If a case is appealed to court, you will also support the Attorney General's office through that process. Qualifications
Minimum Qualifications
Staff Attorney 1 Minimum Qualifications:
- JD degree from an ABA-accredited law school
- Current license and in good standing to practice law in the state of Minnesota is required prior to appointment
Staff Attorney 2 Minimum Qualifications:
In addition to the qualifications of the Staff Attorney 1, finalists for a Staff Attorney 2 must also meet the following minimum qualifications:
- At least two years of experience as a practicing attorney and can demonstrate knowledge and experience conducting legal research, writing, and analysis and providing legal advice.
- Advanced experience in the practice of the relevant tax law;
- Exceptional human relations skills, problem analysis and solving skills; and
- Substantial experience in performing legal research, writing and analysis on diverse and complex matters.
Staff Attorney 3 Minimum Qualifications:
In addition to the qualifications of the Staff Attorney 2, finalists for a Staff Attorney 3 must also meet the following minimum qualifications:
- At least four years of advanced specialist-level knowledge and expertise in several specialized areas of tax law;
- Ability to solve novel, complex or unique issues and provide insights regarding the tax system as a whole; and
- Experience in building and maintaining good working relationships with internal/external stakeholders and providing advice to executives.
Preferred Qualifications
- Knowledge of state statutes, rules and cases in the law related to individual income taxation or property taxation, or corporate franchise taxation.
- Experience drafting litigation documents, representing clients in formal and informal judicial and administrative proceedings, and appearing in court.
- Work experience at the Minnesota State Legislature and legislative process, drafting legislation and bill amendments, or testifying at legislative committee.
- Work experience documenting legislative history, applying the canons of construction and administrative law.
- Experience with the compliance aspects of both state and federal individual or corporate income tax law.
- Working knowledge of the Minnesota disclosure laws.
- Advanced degree such as a Masters of Business Taxation (MBT), Master of Laws in Taxation (Taxation LL.M.) and/or State Bar Real Estate Law certification.

Requires occasional moving of articles such as boxes, accounting records, laptop computer, computer monitors, and other office items.

Provide support to licensed attorneys, preparing asylum applications, drafting motions and uploading documents into ECAS with the immigration court, preparing routine immigration forms for work and travel authorization, hardship waivers, “one-step” filings, removal of conditional residency, consular processing for fiancees and immigrant visas, and gathering supporting documentation needed for immigration filings and court proceedings.

Job Summary

The Office seeks an attorney to join its Employment, Tort, and Public Utilities Commission Division (“ETP”), which is housed in the Solicitor General’s Section of the Office. The lawyer’s primary caseload will involve defending the State from employment and tort claims in state and federal court. There will also be opportunities to defend claims that Minnesota statutes are unconstitutional or to work on cases of state-wide impact.
One of the roles of the ETP Division is to defend the State and its agencies, officers, and employees from tort and employment claims. The attorney we seek to hire will have responsibility for a set of assigned cases (and charges), which the attorney will handle from the initial Answer or Rule 12 motion, through discovery, dispositive motion practice, mediation, trial, and appeal. Mentorship and training are available through formal and informal channels. Because cases can be venued anywhere in the state, periodic travel throughout Minnesota may be required.

Minimum Qualifications
- Graduation from a law school accredited by the ABA
- Licensed to practice in the State of Minnesota or ability to obtain licensures within 90 days of hire
- An interest in handling tort and employment cases on behalf of the State before administrative tribunals, district courts, and in the appellate courts;
- Excellent research skills, and written and oral communication skills (a cover letter with a writing sample is required with application submission)
